Hayward man charged for allegedly selling THC out of his car in Municipal Lot
A Hayward man has been charged in Sawyer County Circuit Court on November 16, 2017, with possession of THC with intent to deliver, a Class I Felony, and possession of drug paraphernalia.
The complaint alleges Ethan Rothgeb, 20, was selling marijuana out of his blue Ford Mustang at the Municipal Parking Lot in downtown Hayward on the evening of Friday, October 6, 2017.
The 9-1-1 dispatch center received an anonymous call at 9:16 p.m. that evening stating that Rothgeb was selling marijuana at the parking lot. “As the city’s Municipal Lot is a typical hang out for older teens and young adults, it’s very common to have multiple vehicles with multiple people at that location,” the arresting officer stated in the complaint. The officer said he walked through the lot speaking to different parties and as he walked by the blue Mustang, Rothgeb was not by the vehicle, nor could the officer smell the odor of marijuana.
Two county deputies and the Hayward police chief also arrived on scene. The Sawyer County K-9 unit then brought out Trace while other officers spoke with Rothgeb.
“A few minutes later probable cause existed to search the vehicle based on positive alerts given by his K-9 who is certified in drug detection,” the complaint stated.
During the search of the vehicle, officers found a clear plastic bag with 31 grams of marijuana in the center console. They also found a red shaker/grinder with a small amount of green leafy substance, a small rubber pipe with burnt residue and a small silver scale. All items were located in the center console.
Also filed on the same day of November 16, is a charge of disorderly conduct against Rothgeb for an incident that took place on Third Street in the City of Hayward on October 19, 2017.
According to the complaint, officers were dispatched to the corner of West Third Street and Florida Avenue for a disturbance in the street.
The complaint stated that a resident on the corner, who lived there with his children, was upset that Rothgeb was driving erratically and at a high rate of speed in his blue Ford Mustang through the streets, and he also said Rothgeb wouldn’t stop for stop signs.
The resident approached the vehicle to speak with Rothgeb and asked him why he wouldn’t slow down and stop for the stop signs because he had small children living at the residence. According to the complaint, Rothgeb said profanities to the resident and said he was going to get his dad, at which time, he drove down to the next block to his dad’s residence.
The resident, and another witness on scene, both described the following events as Rothgeb and his father approached, and the father asked if the resident had a problem, calling him racial slurs and threatened to slit their throats and kill them.
Officers went to the father’s residence and talked with both of them, and they both denied threatening anyone. They told officers the resident was the one who had a problem, according to the complaint.
As officers went back to the residence of the complainant, another resident living across the street spoke with officers and filled out a statement verifying Rothgeb was driving at a high rate of speed and running the stop signs and that she also witnessed Rothgeb and his father threaten the complainant.
Rothgeb is scheduled to appear in court on January 16 at 11:00 a.m. on all the charges.
